APTIGEN TERMS OF USE & DATA CONSENT

By selecting “Accept and Continue”, you confirm that you have read, understood, and agree to be bound by these Terms.

1. Role of Aptigen
Aptigen (Pty) Ltd processes data on behalf of schools, institutions, or authorised entities (“Controllers”) and acts as a data processor, processing personal data only on documented instructions of the Controller in accordance with applicable data protection laws.

2. Nature of the Platform
Aptigen provides data-driven insights, predictive analytics, and career and academic guidance outputs. All outputs are probabilistic, model-based, not guaranteed, and do not constitute professional, educational, financial, or career advice.

3. User Responsibility
You confirm that you are authorised to use the platform, that all data submitted is accurate and lawful, and that where data relates to a minor, appropriate consent or authority has been obtained. You accept full responsibility for your use of the platform and any decisions made based on its outputs.

4. Data Processing
Personal data is processed solely to provide the Aptigen platform and in accordance with Controller instructions and applicable data protection laws, including POPIA. Aptigen does not sell or share personal data for advertising or marketing and does not use personal data for its own independent purposes, except where such data has been irreversibly anonymised and aggregated. Anonymised and aggregated data may be used for research, analytics, benchmarking, and product improvement, and will not identify any individual or institution.

5. Categories of Data Processed
Data may include academic performance data, assessment results, behavioural and personality indicators, and basic identifying information. Aptigen does not intentionally process special categories of data such as health, religious, or political information.

6. AI and Predictive Processing
Aptigen uses artificial intelligence systems to generate outputs. Results are based on statistical models and may contain inaccuracies or limitations. Personal data is used only to generate outputs for authorised users, is not used to train external AI models, and exposure is minimised during processing.

7. Data Storage and Transfers
Data may be stored and processed on secure cloud infrastructure and may be transferred outside your country of residence with appropriate safeguards in place.

8. Security Measures
Aptigen implements technical and organisational safeguards including encryption, role-based access controls, and secure infrastructure.

9. Data Retention and Deletion
Data is retained only as long as necessary to provide the service and in line with Controller instructions. Data may be returned or securely deleted upon request via the Controller.

10. Data Subject Rights
Requests for access, correction, or deletion must be directed to the relevant Controller. Aptigen will assist the Controller where required.

11. Limitation of Liability
To the maximum extent permitted by law, Aptigen is not liable for any loss, damage, or outcomes arising from use of the platform or reliance on its outputs. Use of the platform is at your own risk.

12. Indemnity
You agree to indemnify and hold Aptigen harmless from any claims arising from your use of the platform, data submitted, or breach of these Terms.

13. Intellectual Property
All rights to the platform, systems, algorithms, and outputs remain the property of Aptigen. You may not copy, reproduce, or reverse engineer any part of the system.

14. Platform Availability
Aptigen does not guarantee continuous or error-free operation and may modify or suspend the platform at any time.

15. Updates to Terms
These Terms may be updated from time to time. Continued use of the platform constitutes acceptance of any updates.

16. Governing Law
These Terms are governed by the laws of South Africa.

17. Binding Agreement
By clicking “Accept and Continue”, you enter into a legally binding agreement, confirm your authority to provide data, and acknowledge all disclaimers and limitations. 18. Acceptable Use
You agree not to misuse, disrupt, or attempt to gain unauthorised access to the platform, input false, misleading, or unlawful data, or reverse engineer, copy, or exploit the platform or its outputs. Aptigen reserves the right to suspend or restrict access for any misuse.

19. Educational Use Disclaimer
Aptigen is a decision-support tool only and is not intended to replace professional judgement, institutional decision-making, or educational or career counselling. All final decisions remain the responsibility of the user or institution.

20. Third-Party Services
Aptigen relies on third-party infrastructure and services, including cloud and AI providers. Aptigen shall not be liable for failures or downtime caused by third-party services or interruptions beyond its reasonable control.

21. Force Majeure
Aptigen shall not be liable for any failure or delay resulting from events beyond its reasonable control, including power outages, network failures, natural disasters, government actions, or third-party service disruptions.

22. No Warranty
The platform is provided “as is” and “as available”. Aptigen makes no warranties regarding accuracy of outputs, fitness for a particular purpose, or continuous or error-free operation.

23. Data Accuracy
Aptigen is not responsible for incorrect, incomplete, or outdated data provided by users or institutions, or any outcomes resulting from such data.

24. Suspension and Termination
Aptigen reserves the right to suspend or terminate access, restrict functionality, or remove data where necessary, including in cases of misuse, breach of these Terms, or security risks.

25. Dispute Limitation
To the extent permitted by law, any claims must be brought within a reasonable time period, and liability shall be limited to the amount paid for use of the platform (if any).
